German civil servants (Beamte) and judges do not receive a statutory pension in retirement, but instead retirement pay (Ruhegehalt) under the Civil Service Pensions Act (Beamtenversorgungsgesetz, BeamtVG). The amount depends on the pensionable service pay and the individual pension rate, which increases with every year of service.

For every pensionable year of service, the rate increases by 1.79375%, capped at a maximum of 71.75% of the pensionable service pay (§ 14 BeamtVG).

What Determines the Amount of the Retirement Pay?

  1. Pensionable years of service: Each additional year of service increases the rate by 1.79375% – up to the maximum rate of 71.75% (after around 40 years).
  2. Pensionable service pay: Base salary, family allowance level 1 and pensionable allowances form the basis of the calculation.
  3. Early retirement: Every year before the standard retirement age costs a permanent 3.6% early-retirement deduction.
  4. Minimum pension: Even with a short period of service, at least 35% of the service pay is paid as retirement pay.

Early-Retirement Deduction (Versorgungsabschlag)

Anyone who retires before the standard retirement age must accept a permanent deduction from the calculated retirement pay: 3.6% per year of early retirement (0.3% per month). For voluntary early retirement on request, the maximum deduction is 14.4%; for incapacity to work or severe disability, it is 10.8%. The deduction permanently reduces the retirement pay.

Retirement pay is calculated from the pensionable service pay (base salary + family allowance level 1 + pensionable allowances) multiplied by the pension rate. The rate increases by 1.79375% per pensionable year of service and is capped at a maximum of 71.75% (§ 14 BeamtVG). The maximum rate is reached after around 40 years of service.

In principle, only after a minimum service period of 5 years (§ 4 (1) BeamtVG). An exception applies in the event of incapacity to work due to a recognized service accident – in this case, the entitlement exists regardless of the length of service.

The office-dependent minimum pension guarantees at least 35% of the pensionable service pay (§ 14 (4) BeamtVG), even if the calculated pension rate would be lower due to a short period of service. There is also an office-independent minimum pension based on pay grade A4, which should be checked with the payroll office for a binding calculation.

Anyone who retires before the standard retirement age (e.g. voluntarily or due to severe disability) must expect an early-retirement deduction of 3.6% per year. For voluntary early retirement on request, the maximum is 14.4%; for incapacity to work or severe disability, it is 10.8%. The deduction permanently reduces the retirement pay.

Yes, since the transitional rules of the 2001 Pension Reform Act (Versorgungsänderungsgesetz) were completed (a gradual reduction from 75% by 2003), a uniform maximum rate of 71.75% of the pensionable service pay applies nationwide – regardless of how much longer service continues beyond that point.

This includes the base salary, the family allowance at level 1, and other allowances designated as pensionable under pay law (§ 5 (1) BeamtVG). This total is multiplied by a factor of 0.9901 (pension reserve) before the pension rate is applied.
