How is parental leave calculated?

Entitlement duration, transfer and notice periods under §§ 15, 16 BEEG

The German Federal Parental Allowance and Parental Leave Act (BEEG) grants each parent an individual entitlement to parental leave from birth until the child's 3rd birthday. This entitlement can be split between the parents and can also be taken at the same time.

Since the BEEG reform of 1 July 2015, up to 24 months of the entitlement can be transferred to the period between the child's 3rd and completed 8th birthday — without generally requiring the employer's consent. Only for a third period falling within this later timeframe does the employer have a limited right of refusal for urgent operational reasons.

When giving notice, different deadlines apply: 7 weeks' notice for parental leave up to the 3rd birthday, 13 weeks' notice for the transferred period afterwards. Notice must be given in text form; in urgent cases, a shorter deadline is exceptionally permitted.

Each parent can also split their parental leave into up to 3 periods without requiring the employer's consent — splitting into further periods requires the employer's agreement.

Each parent is entitled to parental leave until the child completes their 3rd year of life (Section 15 (2) sentence 1 BEEG). Mother and father can take parental leave together or separately, including partially.

Yes, up to 24 months of the parental leave entitlement can be transferred to the period between the child's 3rd and completed 8th birthday (Section 15 (2) sentence 2 BEEG). Since the BEEG reform of 1 July 2015, this no longer generally requires the employer's consent.

For the period up to the 3rd birthday, you must give notice to your employer in text form at least 7 weeks in advance. For the transferred period between the 3rd and 8th birthday, a notice period of 13 weeks applies (Section 16 (1) sentence 1 BEEG). In urgent cases, a shorter period is exceptionally possible.

Each parent can split their parental leave into up to 3 periods without the employer's consent. Splitting into further periods is only possible with the employer's consent (Section 16 (1) sentence 6 BEEG).

The employer can refuse a third period falling within the timeframe between the 3rd and 8th birthday within 8 weeks of receiving the request, for urgent operational reasons (Section 16 (1) sentence 7 BEEG). However, they cannot refuse the basic transfer of up to 24 months itself.

No. Many mothers take parental leave directly after the maternity protection period ends, but a later start within the entitlement period is also possible. The only requirement is giving notice in time before the desired start.
